Environmental Law

The Kenya Environmental law defines the legal rules relating to the environment, and more broadly the principles, policies, directives and regulations raised by efforts to protect, conserve and reduce the effects of human activity on the environment.

We as Parseina and Soinei advocates value having a clean and well-kept environment and thus advise our clients on environmental law and regulation. Principally, we advise them on environmental planning, risk, drafting regulations and audit, impact assessment and natural resource conflicts.

According to Kenyan Constitution to include we have the right to a ‘clean and healthy environment. Included are Environmental Impact Assessment (EIA) and the Environment and Land Court (ELC). There are varied sources of Kenya environmental law which include:

  • International law – The International Conventions and International Customary law are included as sources of Kenya environmental law.
  • Constitution of Kenya – The Constitution provides a basis for the administration of environmental laws.
  • Common law – An example of common-law is derived from neighbour law in which the law of nuisance is of importance as a source of environmental law.
  • Statute law – Environmental law is also derived from national and provincial legislation, and from local by-laws.
  • Customary law – Custom law also serves as a basis of environmental law formulation.
