Employment Law

Employment law is the area of law that regulates the employer-employee relationship. They create minimum requirements for working conditions for employees and also regulates the employment of children.

We provide assistance to our clients to form their employment practices to local labour law and market practice. We also advise employers on the best procedure of employee termination whether termination for cause or redundancies or formal dismissals. We also advise employees/employers on unfair termination of employment.

In Kenya, there are different types of termination namely; termination by notice, summary dismissal and termination on account of redundancy.

  • Termination by notice: The employer or the employee is required to give notice of termination of employment contract.
  • Summary dismissal: This arises where the employee is involved in gross misconduct, therefore terminated without or with a shorter notice.
  • Termination on account of redundancy: Arises where employer refers to a shortage of work which is not attributable to the employee personally.
